Repentance avails them nothing, and reform honestly and faithfully carried out. but mitigates their sufferings. She posscses. and what is more uses daily. instruments of torture more cruel and more deadly than man in the most srvage ages has ever invented. Aches and pains. gout. rheumatism. fe- vers, ague.leprosy. sorcs.deliriurn, hypo- eondria. madness—these are the punish- ments, some of them worse than death. that outraged nature inflicts on those who break her laws. Yet no one dare 1 call nature cruel. The severity which she uses is a just, a necessary, and a merciful severity. Equally just. ne- cessary and merciful. the defender“ of capital punishment contend. is the se- vcrity which ordains that whose sheds man's blood. by man shall his blood be shed. If. however. it can be proved tlrat the abolition of capital punishment re- srrlts in diminishing crime instead of in- creasing it, then the arguments in its favor lose all their force, for it must al- ways he remembered that revenge is not an element. ofjudicial pnnislrment. What society looks to in punishing offenders is its own preservation and the reformation of the offender. Preservation first. and then. if possible. reformation, brrt never retaliation. Capital punishment from its very nature. precludes the possibility oi the accomplishment of the latter oi‘tlrese two aims; and if it can be shown that the former can be secured without having recourse to it, then there does not remain a single argument. in furor oi'its perpetu- ation.
