For the information of the Commissioners, | and in order that the general public may | understand the question, I subjoin the fol- | lowing particulars:—In the year 1799, the then Lieut. Governor Fanning, received a despatch from the Duke of Portland, Secre- tary of State, directing Governor Fanning to execute a lease, fo continue during His Majesty's pleasure, of a tract of land then known as the Fort Lot, being the site of the French Capital of the Island, consisting of 520 acres, unto Charles Alexander DeCo- lonne, late Minister of State in the King- dom of France, but then resident in London- (The Abbe DeColonne, brother of the above, was then living on the Island, and his remiins are now interred in the Char- lottetown Cemetery.) The conditions of this lease are the payment of an annual rent, beginning at 3 pence per acre, and after twelve years to be one shilling sterling, rev serving to ¥lis Majesty also “all such part of the said lot as hath or have been already set apart, or that shall or may herealter be set apart for fortifications, wharves, or high- ways.’’ The tenant also covenented to “keep in repairs the houses and buildings on the premises, and to erect and build a suf, ficient Barrack, for the use of His Majesty's troops, stationed to guard the battery. Provided always, His Majesty shall be at liberty, with or without previous notice, to resume possession of any part of the said tract, as shall be judged to be necessary or expedient for works of defence, or for any other public purpose, allowing an abate. ment therefor of a proportionate deduction of the rent, reserved for so many acres as shall be resumed for the purpose aforesaid.”

Cumberland, for Lot 65—$5.15, and the $2.27 given to Lord Melville, and the $1.46 to the Hon Ponsonby Fane, for their interests in township 29—the lands on both these properties being of equal qulity and value with the lands on township 69— would not have been so great, and the settlers on lot 65 would not have been de- prived of an equal participation with the tenants on other estates, in the advantages of the Land Purchase Act.

As the means of correcting any error in the awards made by the Commissioners’ are provided for in the 45th section of the Land Purchase Act, 1875, it is to be hoped that the Government will, within the thirty days limited by the Act, take such steps as will protect the public interests involved.

I may add, that the “ Fort Lot” or “ War-
