A CRISIS seems to be reached in the hia- tory of these beautiful Gardens. As our readers are alrendy aware, their «existence and ¢ontinuance have been due to the taste, labor and perseverance of Mr. Arthur New- ber y. until this year, been defrayed by coutribn-

of cit: zens held every spring. This system was obj -ctionable for two reasons —the first because the task was distasteful to the kind ladies ; and secundly, because it was felt that as the Gardens were for the adorn-

burden should fall equally apon all who enjoyed their beauties. On Juve 4th of this year a meeting of citizeus was held in the Board of Trade Room, when Hon, T. H. Haviland, the Mayor, acted as cheir- man. The opinion of this meeting—a large and representative one—was what we have just expressed, and that the Provincial Government might with propriety be asked to give a grant forthe Gardena, while at the same time the City Council should have a similar request made of them. The question then arose whether or not the Counci) would be justified in making the grant before there were evidence that the citizens really desired the Gardens perpe- tuated ; and as a safeguard, a large com- mittee was appointed, whose obtained the signatures of a large number of citizen taxpayers to a memorial to the Council, asking that a grant be made annually for the Gardens and the amount added to the estimates of annual city expenditure. The Provincial Government and the City Council each promised a grant and the work went ahead under Mr. Smallwood’s capable hand, Mr. Newbery continuing to manage the finances. Now, however, hitch appears. Mr. Newbery assured the meetiny held in June that there were bo arrears to be considered, and the granis were made for this year’s expen- diture only; but Mr. Newbery now pre- sents a statement of account showing a con- siderable deficit, including a balance
no evident means for discharging the in- debtedness. The feeling of the meeting held yesterday was undoubtedly that the grants should be devoted to this year’s ex- penditure only (for which purpose they would be sufficient), and that while Mr, Newbery should have stated to the June meeting the existence of adeficit, he should not suffer the loss of the amount, —which, however, must be realized in some special way. A committee was appointed to ob- tain astatement in detail of all disburse- ments, indebtedneasses, liabilities,and moneys
recaived, and the committee will report to a meeting to be _ held in the Board of Trade rooms at
11 o’clock next Monday, when there should be a large gathering to devise means whereby all just indebtedness may be removed, and a clear start made for next year’s gardens, It was the opinion of the meeting yesterday that a committee of management should be appointed—one mem-

One person of the committee should be treasurer to receive all grants and make all disbursements, and his accounts should be duly audited by persons appointed for the purpose at the annual meeting of citizens. This is a busi- ness like and sensible plan. Its adoption is almost acertainty. By these means the annual outlay may be made notto exceed the guaranteed income. There will be no more collections, deficits, uncertainties.

Mr. Henry’s Case.
Srr,—The Hon. James R. McLean has not thought fit to come forward and explain tothe public his reasons for dealing so harshly with Mr. Henry, the contractor of Granville bridge
Neither has the Patriot said anything in justification or defence of Mr. McLean. The reason for this silence is obvious: their conduct is not defencible.
What does it matter to the Hon. James R., although Mr. Henry has workmen to pay, and material also to be paid for, so long as he is in receipt of his salary and the spoils of the Public Works Department at his hands? What cares the noble Prince of the Kast who suffers, so long as he is autocrat |
Mr. Henry is harshly dealt with and the non-committal Peter might at least see that justice was done to one of his constituents, iit is to be regretied that the people of this ; Province are so apathetic as to allow them- \eelves to be without a law upon the statutes of the Province giving any of Her ,Majesty’s subjects the right to sue the
Crown in matters of contracts or otherwise.
With such a law upon our statute books, idefining the course to be pursued by any ‘persons aggrieved with their dealings with ithe Crown, such snobbery and snobbish- ‘ness as practised by Mr. McLean would | goon be settled at the bar of the Court of Chancery.
We have lawyers in abundence and they have been tinkering at the business now for many years, and to their disgrace be it said this Province is without a law giving the subject this right.
You have to go with your hat in your hand and bow to Mr. Fred. Peters, and if it meets his wishes, he may advise the Governor to sign a fiat but not otherwise. This should not be so
The bridge in dispute has been taken off Mr. Henry’s hands, and now for nearly six months the public has had the use of the bridge and Mr. Henry, the contractor, and his men are unpaid
