Governor Prank Dixon said to- day that seven lashes were admin- istered by Warden J. Curtis Wel- don, Sxn. to each woman following a free-for-all fight that developed when an inmate was denied a man- icure Saturday ln the newly-install- ed prison beauty shop that was de- signed to improve morale and teach a trade.

The Governor said the women were not injured by the whlppings. "But we just don't use those meth- ods in our prisons," he said.

"Phillips had e grey overcoat and a felt hat." Phillips had a. blue overcoat and not a grey overcoat. He was abie to see after midnight a block, even two blocks away. He was able to tell this fellow a block or two blocks away. Phillips had a blue overcoat and a felt. hat. Lund had a grey overcoat and a cap. The whole of his evidence is oh- par with that. As I say, you heard the evidence and, as the o.d adage goes, "Birds of a feather stick to- gather." No doubt about that. Now that's their story, gentlemen, and let me tell you this: If the story of the prisoners is to be believed. and as corroborated by their witnesses. then they didn't commit the crime. It is therefore necessary for you to consider well is that evidence to be believed? Do you believe that evid- ence?

Important Part

Now then, gentlemen. we are coming to the important part of this case. I am simply leaving the evidence so far as the evidence goes. I am going to try to assist you in coming to a conclusion of what actualiy took place on that terrible night. I told you We had some di- rcct, definite, and positive evidence in regard to certain facts. And we have. There are certain other parts of the evidence from which you must draw your own con. clusions and inferences, and I am going to submit to you certain positive facts that have been sub- initted in this case. There is absolutely no doubt about this: that on the morning of the 31st of January last at ten min- utes past twelve o'clock the prison- ers ln the dock were caught in the store of Peter J Trainor. No doubt about that. That is definite. They admit themselves they were in but the Police Officers definitely fixed the time. The next thing I submit to you for our consideration: what were they oing in that store? They say they went in their innocently to buy ginger ale and they have de- scribed to you how they We!" l" there. I have already gone over that and 1 am not going to repeat it. D0 you believe that story or do you think they went in there for the deliberate purpose of stealing? What evidence is there that these parties were stealing? There's the evidence that seven packages of cigarettes are found on their per- son by the Police Officers after they were taken to the Police Sta.- tlon, five on prisoner Lund and 2 on Phillips; the same kind of cig- arettes as were being sold by that man in his store.

l-lave you any doubt what was being done there when the cash register rang? Why would they g0 in the store and ring a cash register -no lights on at all. Do you be- lieve their story? To me it is ab- solute folly to think reasonable men wouid come to that conclusion. Now did these men go for the purpose of stealing or to buy ginger ale as they say? In the next p ace, if they went there how did they get in? Well clearly, gentlemen, if the evidence Lof the ollce officers is to be be.

I will tell you what happened in my opinion. The men went there for the purpose of holding up this old man. Not for the purpose of murdering him, no. They went there for the purpose of holding him up and stealing. And what evidence is there for a holdup? The strongest possible evidence that I could imagine. ‘There. I say, is the blackjack Who took that blackjack there? Gentlemen. it is for ou to judge whether it was wlthn the range of reasonable pro- babillt that anyone else would be in that.’ store that night other than the prisoners at the bar.

Do you think it is possible that anyone else could be there that night? Many things, gentlemen, in this world are possible but to me it would be highly improbable to think that anyone else was there; I re- peat, is it within the range of rea- sonab‘e probability that any other person was in the store that night other than the prisoners? They were there. In any case, if anyone was there unquestionably they took this skull cradrer or blackjack and the had if for a purpose. An I don't think it is very hard for you to come to a conclusion that thLs blackjack was used on this poor defenceiess old man when shot

Is that all in connection with this terrible crime? No, gentlemen, no. What further do we find? We find that on that night Phillips is dis- covered with what? A handkerchief about his neck. What do these hold-up men do as we know from our observance in life? There in cities and other placer we know passing along innocently are harm- less-looklng welLdressed men and what happens suddenly? Suddenly they open a bank door. They have ther handkerchief pulled up over their face, they are then in dis- guise. Up goes the handkerchief, along comes the gun -"Hands upl" Was that not the purpose of the handkerchief and dummy gun on the men that night? What else could it have been there for?

I now ask you. first: what were the prisoners doing in that place? Answer that. question when you go t0 your juryroorn. _

Next: how did they get in there? They didn't break in. There is no evidence of breaking in. How did they get in? Could they get in by any other means than the front ' door? Do you think that old gentle- man would have this dummy gun in his store for sale? And this blackjack? Where did these coma from? The dummy gun Wis found on Earl Lund. What did be have it for? Ask yourselves again was it a hold-up? and see how you answer that. These are ‘he thingi. 88ml?- men, you have to consider. It is all very well for these prisoners to come in here with the story they tell and they may be telling the ,iruth. It is a matter for you. Look at the evidence submitted by them and the witnesses corroborating them regarlng the time, and con- sider if you should place any cred- ence in what they say.

I am trying to assist you gentle- men ln arriving at a conscientious conclusion and 1 have placed be- fore you as best I can the evidence that was submitted in this case so that it may assist you in arriving at a conclusion. But having come tc that stage of the case would you need anything more? If you had no additional evidence would you need anything more to arrive at a con. sclentlous conclusion?

But, gentlemen, there is still some cvdience that speaks most eloqu- ently but, I regret to say, eloquently in only one direction and I think

is. To what do I refer? I refer to the blood, the human blood, that was sputtered on all the garments of the prisoners in the clock. on their cap, hat, overcoaie, and on that handkerchief, gentlemen. Now I want to ask you as intelligent men how did the two hairs get on that handkerchief that was around Phillips’ neck? You heard Dr. Smith sa that they were identical

There is thei ev dence of that gun; there is the evidence of that handkerchief. You might very well say, "Oh. there is no evidence that this chap Lund had a handkerchief." I can only say this: if there was a holdup that night, they naturally would bothi be in disguise some way. I don't know what that disguise might con- sist of. It might be that a cap can be pulled down,

I suggest this further: they went there for the purpose of holding-up thL; man. They did not go there, I! am satisfied, to murder the man.| Why do I say that? Because they; would have token a weapon of this kind, the real thing, a gun, and shot the man. or else a. knife or n dagger or something of that kind. But nothing of that kind happened. I will tell you what appears to me to have happened. 1 would not be surprised if Lund did have a dis. guise that night as he would like- be known by the deceased since he lived around there, at least in Charlottetown, for twenty years
