Does any one serioasly ineulpate the Execu- tive on account of the tailure of their treaty with Messrs. Walker? It has been objected, indeed that they might hava called together the Legis lature, to amend the defect in the Law whch here 8 ood in their way. Yet would they bave been justified in so doing? Might they not thus hace npperiiled their whyle Railway policy, and even wrecked it? Woat then weuld have fol lowed, but anarchy at home, and con empt and | distrust abroud?—resuits asgured'y which no true patriot would desire to witness. -

We come now to Mr. O'Brien’s case. The | Government had demanded a4 security, on the | part of any firm with whieh they might enter into contract, a deposit to their own cvedit, of | certain designated cash consols, or bonds. to the | amoant of £100 000 currency ; which amount, | in the event of any breach of contract, was to be paid over to them, and applied by them toward: the construction and completion of the ro rd.
