beginning of the Confederation era. Bear- ing this fact in mind the following pro- visions of the Act 53 Vic.. Capt. 4 seem, by implication, to be conclusive :—

(1) Except as hereinafter epecial~ ly provided, no person whois a member of the Senate of the Dominion of Canada, or a member of the Dominios House of Commons, or who accepts or holds an office, commission or employment in the service of the Government of the Province of Prince Edward Island, at the nomina- tion of the Crown, or by. from, through or under any department in the public service of the Dominion of Canadaor the Province of Prince Edward Island, to which an annual salary is attached, shail be eligible as a member of the Legislative Council or House of Assembly, nor shal! he sit or vote in the same, respectively, during the time he is a member of the said Senate, cr a member of the said | House of Commons, or during the time ' he holde such cffice, con. mission or ems ploy meut.

(2.) Nothing in this section shall ren- der ineligible, as aforeaid, any person holding any of the fcllowing offices, that is toany: Provincial Secretary~Treasur~ er and Commissioner of Public Lande, Attorney General, or Commissioner of Public Works, or shall disqualify him to sitor vote in the Legislative Council or House of Assembly : Provided he be elect- ed while holding such office, and not other- wise disqualified, and be also at the same timea member of the Executive Council of this Province.
