First day of the trial of Heath William Bowley. Parkdalc. is over. He was arraigned before Mr. Justice Mark R. MacGui. gan at the first day of Queens County Assizes on Tuesday. when the Grand Jury of the Sup- reme Court brought in a true bill on the charge of rape. and the trial opened yesterday be- fore the Petit Jury.

Immediately after the jury was settled, defense made ap-. piication for withdrawal of all witnesses from the courtroomi until after they had shown evid- ' ence. The application was ac-i cepted by Justice MacGuigan. and all witnesses present with-1 drew to the witness‘ room to await call.

Deputy Attorney~General J.‘ Arthur McGuiigan called the pro- secution's first witness. Janice Mary MacKay. a serologist with the RCMP crime detection lab- oratory in Sackville. New Bruns- wick. She testified as to the re- sult of tests carried out by her. on the exhibit designated C-2. when it was delivered to her in the lab at Sackville.

The second witness called was Dr. Athol L. Roberts. of Char- lottetown. who testified that he; had carried out a physical ex- amination of Mrs. MacLaughlin; on the night of Oct. 29 in the outpatieint department of the P.E.l. Hospital. He reported that he had found bruising but no lacerations on the head near the. eyes. and on the egs. .

The afternoon session began with the calling of the complain- ant. Eleanor Mclody Mrs. Ed-‘ ward) MacLaughlin. who gave‘ as her address 206 Fitzroy Street in the City. After iden- tifying herself she proceeded to} relate an account of the events1 of the day in question. Oct. 28, and the following day.

When the prosecution was fin- ; tshed. Mr. Nicholson took over: and proceeded with thorough cross-examination of the wit-‘ ness. which did not terminate. by the time Mr. MacGuigan re- cessed the Court. Continuation‘ of the cross-examination will. take place this morning at 10:30! when Court reconvenes. 2
