The prellminazy hearing in the case of the King vs Jcim Suther- land MacKay of Springfield, Lot 6|. charged with manslaughter in cou- nection wlth the death of Mrs. Stephen Gallant, who was found dead on the highway at New Ann- an earfy on Sunday morning. June 21st, opened yesterday montliig at the Court House, Summerside, be- fore Magistrate Darby. Mr. LG. Lewis. KC. appeared for the C.own and W. Henry Noonnn for the accused. Sgt. K.W.H. Engel conducted the case for the RCMP. Inspector JR. Wright of the R..C. M.P. was present. The first wit- ness callxi was Elmer Phillips of Summerside. but now of the Mer- chant Navy.

He gave evidence that he recalled the evening of Satmday, June 20th. He tras out in Kenslnizion and re- turned home about 10.40 pm. When at Dutinings Corner. K-ehsington, he lialicd a. car, two men were in it. 11c recognized them in court. They l0‘d him their names. Ono was a young tnzin about 19. H: asked them if they were going to Summersidc. Did not hear anyone when they got out.

0n Sunday afternoon the wit- ness went up to Sutmrlanas place. "We talked about what we -weie going to do next day." Monday he went to hoe turnips for Sutherland. While there he was told a woman was killed and Sutherland said. he was going to Charlottetown to n» port the accident to his our and that he. the witness, had better go with him, as he was with him in the car. in answer to question he replied did not see anyone when they stopped to pick up the light.

Constable Trenouth. gave evidence similar to that given at the inquest telling how he found the body and after investigation found Sutherland MacKay had a car with broken headlight and that the piece found on the road fitted in with the brok- en pieces of lens of clutherland MacKayl; car. He got Albert Learcl, gara man to examine the broken lens e found on the road and he found they "fitted berfti:t.,v" with the broken lens on Sutherland! car. l-Ie also found something that looked like hairs on the car. There was nothing on the highway to ob- struct the vision.
