This is an appeal from the deci- sion of the Judge of the County Court oi‘ Queen’s County in an ill- terpleader granted on application of the ‘Sheriff of Queen's County in the following circumstances:

Montgomery the appellant above named had recovered judgment in the said County Court against Ells- worth Diamond the defendant in the action for damages resulting from a collision between. an auto- aobile driven hyuthegtleiendant

Upon this judgment an ex- ecution was issued indorsed to levy for the sum of $125.25 ibeini; the amount of the judgment debt and costs and was delivered to the sheriff of Queen's County who lac- cordingiy seized and levied upon the said automobile then in pos- session ot the judgment debtor as the property of the judgment de‘b- tor, whereupon the respondent, an elder brother of the judgment deb- tor. claimed the automobile as his property. ‘it appeared that the troliision took place in Charlottetown Aug- ust 1924; action was commenced ‘December .1924 and on the 31st. oi March 1925 judgment was given for the plaintiff (appellant herein) for $116.25 ‘and costs. On the triui Ellsworth Diamond (judgment deb- tor) was defended by counsol ro- tained dry the claimant (respond- ent herein). No appeal was taken against the judgment.

in July following the claimant negotiated for the purchase of a "Dodge" car at the price of $1475. The "Star" car was turned in at I860 and the balance was settled ‘by a cash payment oi $225 und a promissory note of the claimant's for $400.
