Destruction of a Canadian Town
A Quebec telegram says, in reference
to the destruction of Somerset, P. Q. :—} “The total loss caused by the fire is es-|

A recent opinion of the Pennsylvania Supreme Court lays down the law re- garding insanity asa defence in murder triuls forcibly and sensibly. A convict in the peniteatiary killed bis keeper,and his counsel, in default of any better plea, tried to save him from the gallows by the claim that he was of unsound mind. There was evidence enough that

mental condition When he committed the murder, and experts were ready to testify that lhe ought not to be held re- sponsible. But the Court ruled that “mere moral obliquity of perception” should not protect 4 person from punish mentfor a deliberate act, and thaw “moral insanity” is nota sufficient de- fence unless it be shown that itis potent enough to “subjagate the intellect, con- trol the will, and render it impossible to do otherwise than yield.” In other words,a man may labor under delusion, hallucination, or partialinsanity, yet if he understands the pature of his act and knows that itis wrong, he must be held responsible. This is the common- sense View of the question, which any impartial person would tako unless his tnind were confused by the subtleties of professional experts ia alienism, The iffirmation of this doctrine by the bigh- est court of such a State as Pennsyl- Vania strengthens a tendency at judical interpretation iu the right direction. A dozen years ago “emotional insanity” wus a most popular and successful plea in any desperate murder case, and it brought the administration of justice into contempt. The craze, happiiy, seems to have rua its course, and the old common-law doctrine regarding insanity is vow pretty well re-establish- ed among our neighbors to the south- ward.
