Napaser, Dee 5.—The trial of Ponton ani Meckie, on a charge of robbiog the Dominion bank here of $40,000 on August 27th 1897, is ended. Te jury was unable to agree on a verdict in the case of Ponton, bat round Mackie guiltv. and he was sen- tenced to ten yearsin Kingston Peniten- tiary. Ponton was releared on $10,000 bail, peoding anew trial. The feeling in Napanee is strongly in Ponton’s favor.

Havirax, Dec 5—The Dominion Line steamer Labrador, Capt Erkine, from Liverpool and Moville with weekly mails and passengers, arrived in port at 3 o'clock yesterday afternoon, making her tirst vieit ofthe season. The steamer met witb fair weather on the passage,a heavy eea, but no storm, temgencountered. Her average speed was 300 m le-, but from noon Satur- day to noon today she covered 340 miles. She brought 27 cabin, 3i second cabin and passengers 129 steerage. With the exception of four cabiuand about 25 steerage, all landed here.

Tuespay, Doc 6. Philips vs Gillis—Action of ejectment submitted tothe Court in a speciul ca-e. Wm. Dodd, as to the real estate in ques- tion, died intestate, leaving him surviving one brother, two sis‘ers, one nephew and twogrand nephews—his father also being dead. Tne property was sold to one,Gillis, One of the grand nephews of Wm Dodd,brought an action of ejectmeat sgainst the auid Giliis who had gone into puesession, and the matter was submitted to the court by way Of a special case. The question involved is whether the grand-nephew is under the statute, and in the present case, one of the next of kin of the late Wijliam Dodd. The Robinson Co. gave their opening last evening, presentiog Fra Diavolo. The inclement weather militated against th atiendance, ard asthe compauvy did not arrive in the city until about half-pact seven it was almost nine o’clock before everything was ready and the curtain wentup. The part of Fra Diavolo was well taken by Mr Frank D Nelson; and Mr Charles N Holmes, as Lorenzo, eleo sung and acted bis part cleverly. Minnie Jarbeau, the prima donna of the company, gave a capital rendering of the part of Zerlina. The other characters were in competent hands, Mesers Young and Oakley furnish- ing much amusement as the “brave” fol - lowers of the bandit chief. An exceedingly pleasing feature of the performance was the singing of the sextette at the close of the second act, and the andience was so delight- ed that a curtain call was insisted upon, The prayer songin the same act was another feature that was most pleasing and effective
