Some time ago, the branch of the Dominion Alliance in this Province laid claim to half the amount of the fines ob-

tained from those convicted, at their prosecution, for violating the Canada Temperance Act. This was refused by the Stipeadiary Magistrate, who paid the mouey thus obtained into the City Treasury A test case Was instituted

Mr. MeKivlay, a prosecutor, brought an

action in the Stipeadiary Magistrate’s Court, for half the amount of a fine. Mr. Vitzzerald’s decision was adverse to him,

and he appealed to the’Supreme Court of this Previnee. The appeal was allowed and the Stipendiary’s decision reversed. "he City Council then appealed to the Supreme Court of Canada, by which the decisicu ofthe Supreme Court of this Proviace has been reversed and the de- cision of the Stipendiary Magistrate sus- tained

Unless there be another appeal to the Privy Council (which is unlikely), the right of the city to get the benetit of the fines i3 established; and as the city is jast now in want of funds, we may expect that, forthwith, a vigorous prose- cution of offenders against the Scott Act will be set on foot by the city officials. It would be a good idea to offer special prizes to the policeman wh» will secure the largest number of convictions! At any rate, we may be sure that every policeman or other officer of the city, who does not prove to be zealous in the prosecution of offenders against the law, will be discharged.

Another Dispute.

And now there is another dispute about boundary lines between the English (or rat’er Canadiaus) and the Americaas. Thistimeitisin the far away northern regions of Alaska and the Dominion territory. Gold deposits have recently beeu discovered on the line between the two countries, and the dis- pute lies with the miners who are resort- ing to the new gold fields. Great difficulty has already arisen because the settlers and claimaats are unable to determine whether they have “located” ou United States or British territory. It is feared that serious controversies may arise in the future, unless the boundary can at once be fixed; and| already the euforcement of custom laws along the boundary, particularly where

the miuing claims are located, has become very difflealt. It is said that

the seekers for gold have, in many cases, pushed far beyond the boundary into Dominion territory about the head waters of the Yukon River: but the coast itself is so irregular that it must be a matter of the utmost difficulty to determise where British authority euds 2ud United States authority begins. A few years ago, when the United States acquired Alaska, it was not considered probable that the contiguous cold, bar- rep, British territory would ever be settled, or that boundary disturbances should ever arise; but gold, “ the root of all evil,” as those who haven't any are pleased to term it, causes trouble— or, we should rather say, causes emigra- tiow, settlement, push, energy, vim, euterprise, aud brings out especially the great qualities of the Anglo-Saxon race as colonizers aud developers of the natural resources of all paris ol world, from the most torrid regions to the most unpromisiog arctic zones.

PoratTors—Choice Prolifies and Hebrons are a little firmer. Sales of Prolifics at 65 to 68c¢ and Hebrons at 63 to 65c. Rose and other kind rule quiet at 50 to 60c per bushel as to quality.

Eoeos—The market was tirmer yesterday, with sales of Eastern at 14} and 15 cenis per dozen, and Island at 14 and 14} cents.

Oats—Th) market is very quiet and prices are lower. We quote No. 1 white at 454 cents: No. 2 white at 41 and 415 conis; No. 3 white at 403 cents; ana mixed at 39 and 40 cents per bushel as to quality.

Fisn—T ere is not much change to note in the Fieh Market, Trade is not working up with any life, and dealers are cautious about buying round lots. The Mackerel catch continues light, and fare lots com- mand full prices. Sales are reported at outports at $3 for medium and $7 for large 3's, with bbl. and $3 25 per bbl., as they run. This indicates a further slightaivance. Inspected jobbing lots are selling at $3.25 to $350 for medium and $6 50 to $7 for large, thohgh it would be difficult to buy a separate lot of large 3's under $7. Nova Scotia large 3's are not easy to sell over $6 to $6.50 per bbl, but most of the stock here is held higher. Old shore Mackerel are quiet at $2.75 to $3 per bbl. The Mackerel fleet are now passing to the eastward of Boston and tind very few large schools. Most of the hauls in Massacnusetts Bay last week were small fish. In codfish there is not much doing. Old dry bank are in moderate re- quest at $2.75 per qtl, and pretty weil sold up. Very little few codfish of any kind offsring or wanted at present. Hake, hatdock and polleck are without move- ment of importance aad prices are romi- nal. Pickled Herring are inactive, with hardly enough sales to base quotations upon. Smoked Herring continues plentifal aud prices are low. Sales of tucks at 5 and Gcents; No 1 at 8 cents; large medium at cents ; and strictly choice medium at 12 cents per box. Fresh salmon have been selling at 14 and J5 cents per lb.

Decision in Island Cases.

Orrawa, June 25.

The Supreme Court of Canada yesterday delivered judgment in three important Island cases.

In the case of the Queen ws the Liqnida- tors of the Bank of P. E Island respecting the Crown prerogative and the claim of the Government to full amount due by the Bank, the appeal was allowed, and Judge Peters’ judgment reversed with costs. The Crown, it is laid down, must be paid in full,

In the case of Ings vs the Liquidators of the Bank of P. E. Island—a case involving the right of ‘‘set off’ toa claim of the Bank—the decision of the lower Court was also revers- ed with costs.

And in the case of Fitzzereld vs Me- Kanlay—a test case as to the appropriation of Scott Act fines—the appeal was allowed, and the judgment of the lower Court reversed with costs,

Tue Templars’ Moonlight Excursion last night was a very pleasant and enjoyable affair. The high winds prevailing at the time of cmbarking deterred a great many from going it is due to those who patronized the excur- sion to say that the committee of management had fireworks ov hand, but were prohibited from using them as it was considered unsa‘e to do so.
