AMHERST, N. S., Feb. 20—A boy wild‘ not so many years ago studied his lessons under the eyes of, Mrs. Elmer Smith and played with her son, was in jail here tonight, joint- ly charged with murder. In another cell was a companion, who, police claim, was called in by Alvah Hen- wood when he lacked the nerve to go through with a robbery plan alone.

companion, was taken at the home of an aunt ill Sackvillc, 10 miles across the Tnntramar Marshes from this town. Both were charged

formally before Magistrate A. G. ,MacKenzie today, but they will have separate preliminary hearings, Henwood coming up on Thursday and Smith on Friday.

Both had attended the inquest into Mrs. Smith's death. In the possession of Crown Prosecutor C. R. Smith, K. C., arc statements which police say were written from the verbal dictation of the two youths, both confessing the crime.

Part of the $128.00 taken from an upstairs l'oom after Mrs. Bmlth was choked, beaten and knlfed to death was spent; in the pool room operated by her son, Wilson, who discovered his mother's body early 0n Saturday morning, February 4, according to information in the hands of authorities.

The reward of $500 offered joint- ly by the town and the provincial government is understood to have a bearing on the Hcnwood and Smith arrests.

Police have a knife, taken from Henwoods home, which they claim was used to take Mrs. Smith's life. They say too, that the “confession” documents are substantially cor- roboraiive, setting forth that Hen- wocd contemplated the deed a‘ week before its actual commission, later ‘ ’ '1‘. eman Smith-no re- lation to the dead woman-to ac- company him to her home, where they forced" their way in and grasped her by the throat after she had told them her son was not at home.

The statements, which will be produced at the preliminary hear-Q Inge, say that Smith struck ‘the’ woman with a bat he carried under his coat, and that Eéhwood, kneel- ing beside the prostrate form, pro- duced liis jacknife and with his eyes closed placed it against Mrs. Smith's throat.
