POLICE COURT-At the Police Court yesterday morning, one pro- hibiticn case was dismissed, and the defendant in a second was fined five hundred dollars or three months. A motorist charged with speeding was fined five dollars and costs, and a man charged with the breach of the sanitary bylaw was fined two dollars and costs.

About twenty five minutes to eight he drove into Summerside from the filling station and went to the postoffice, and was return- ing to the filling station when the accident occurred. "A car coming from the west with very‘ bright lights blinded me. I kept looking towards the ditch. Just as .the car was abreast of me I noticed a horse and wagon in. from. oi me. I could not pull out to avoid it, on account of the other car, so I tried to clear it by pulling into the ditch. I did not feel a jar. Afterwards I got out on the left side and went round to the side walk. I saw a man lying on the lawn at Dowlan's lot. I told them to take the in- jured man to the hospital. I then asked Fred Blacqulere to drive me to the Mounted Police office. On our way we stopped at my father's place and I had a drink. Blacquiere then drove me to the Mounted Po- lice office and I told them of the accident. The officers went with me to the scene of the accident and afterwards found Officer White of the Summerside police who went with us to the hospital. They afterwards locked me up in the Prince County Jail."

Mr. Lowther at the commence- ment of his cross examination ask- ed: "You admit that round about 8 o'clock on Sept. 5th. i932, you killed Phillip V. Arsenault."

Question: "At that time you were driving your Chevrolet roadster."

The report revealed an unchang- ed attitude on the subject of liquor, expressing conviction that Govern- ment sale was not a solution of the problem. It urged that temperance education be carefully and system- atically given in churches and Sunday schools.

The conference expressed its ap- preciation of the action of the House of Commons in rejecting the Senate bill to license sweepstakes in Canada.

On the subject of penology, the report approved all reforms at pre- sent applying to prison ‘administra- tion.

With reference to motion pictur- es, it was regretted that "an in- stitution with so great possibilities for good, should be so often pros- tituted to base purposes."

A resolution was passed that the Prime Minister of Canada be re- quested, through his Government, to instruct Canada's representativ- es at the Disarmament Conference to protest against sdioumment without agreement for- substantial reduction in armaments.

The report of the Home ivitisslon Board was presented this evening. Grretings from the Women's Mis- sionary Srcieiy for the Maritimes were brought to the conference by the President, Mrs. L. W. Parker, of Springhili. Rev. Leonard Bacon. formerly of Nappan, N. 3., gave an account of his work among the Indians in Manitoba.

He did not hear a crash. "I was too excited when I saw the wagon. Could not say just how far I went. I slowed down to fifteen miles an hour."

His evidence as to the conversa- tion between him and Frank Altken differed but prisoner admitted that he said "I'll make you prove I'm crazy."

Continuing,‘ witness stated his car was badly damaged in a pre- vious accident and that the lights were not just right. He thought that the way his lights were now they threw the light down on the road and that he could see better. Asked why he kept on going when the lights from the other car blinded him, prisoner said "I thought the road was clear.

Mr. Lowther: “Did you think you had a perfect right to go on?"

Answer": “Yes I did." ‘

Mr. Lowther: "And you did keep on going and see what you did. You killed a man and smashed a wagon to pieces."

Fred Blacquiere, witness for de- fense, examined by Mr. T. A. Campbell, testified that he was at his uncle Mr. Giuliani's, who lived next door to Charlie's house. He heard there was an accident and went to the scene, went as far as Sam Brady's and parked thc car. There was quite a crowd, talk- ing and looking at Cahill's car. He did not notice anyone on Dowlan's lawn. He asked if Charlie had been hurt. He did not see anything but prisoner's car. "I went back to my car and prisoner was there. ile asked me to drive him to the po- lice office. I did not see anything of injured man. We drove east and

to CahilYs father's house and he asked us to stop. He appeared to walk alright when he got out to go to his father's house. He did not say much about the accident but appeared to be rattled. He was in there a few minutes and then We drove to police office. When he got back in the car I noticed a smell of liquor off his breath."

Cross examined, witness said he had often driven on that street. It is a good street. He did not ask Cahili any questions.

Harry Schurman of New Annan. (sworn) said he was at Bob Grady’! about 15 to B on the evening of Sept. 5th last. While there he heard a noise and a crash. He could not see the cause of it but it seem- ed to come from the west. “Mr. Ramsay, Mr. Grady and myself all started down to the scene. There was a cart coming from the west. It was about thirty yards from Grady's residence. I was just on the sidewalk when I saw the car coming from the west. It was dark. Th5 lights of the car were bright. We arrived at the scene in a few seconds. We found the injured man in the gutter. There was some ahead of us. Afterward I found a horse lying between two lots. He did not appear to be hurt, I got him on his feet. Prisoner did not appear to be intoxicated.”

George Ramsay, New Annan, corroborated the evidence of pre- vious witness as to what time they were at Bob Gradys house, and also as to what they did after hear- ing the crash. He did not think there Wu anything wrong with Cahill.

Alban Gallant, sworn, stated the prisoner was in his barbcr shop be- tween 9-9 on the momlng of Sept. 5th. He saw him again in the even- ing st his service station Just out- side the town limits at the extreme end of Water Street. Cahili served him wih gas and oil: "he iwkiid m)’ car over to see if it was all rip-ht.

Mr. Joseph J. Gaufidz-t, Proprietor of Capi- tol Theatre, Sum- merside, Succumbs Following Paralytic Stroke.

Citizens of Summerslde were shocked to ieam of the death at ten o'clock on Friday morning of Mr. Joseph J. Gaudet, proprietor of the Capitol Theatre, Summerslde.

Mr. Gaudet and his wife were on a. holiday trip through Nova Scotis. and were at Maitland on Thurs- day evening when he became ill.

Word was received by his son Mr. Harold Gaudet at Summerside about midnight that evening that his father had suffered a paralytic stroke and was unconscious. An- other telephone message at 7.30 Friday morning was to the effect that he was still in the same con- dition. Mr. Harold Gaudet and his sister, Mrs. Harold Huestis, left that morning by motor f0 go t0 their father.

Shortly after 10 am. another message was received that Mr. Gaudet had just passed away.

His brother, Henry Gaudet, left

Mr. Gaudet was born in Sum- merside fifty-three years ago and was the son of the late Albert Gaudet, a well known Summerside citizen. Mr. Gaudet

has lived all his life in his native town and was always to the fore
