Mr. Carson, supporting the Do- minion Government's contention that the section of the Sask- atchewan Act should be declared uitrs vires. said that the legisla- tion, conflicted with the interest act because it. took from the lender the right to fix the interest rate on e loan.

The contested section of the Sasket ‘ H ect provides that in any yeer in which a farmer's crop yield is less than $6 per acre. the principal owing on ell mortgages shell be reduced by the amount of interest; due. The section would also recs-rd the final payment of the principal for one yesr every time there is a crop failure.

Hon. J, L, Rulston. counsel for the Attorney-General of Cenade. already has celled on the court to declare the section of the sct ultre virel because it conflicts with in- terest, insolvency and bankruptcy legislation, which falls under Fed- eral jurisdiction.
