SESSION OF

The triennial meeting of the Diecesan | Synod of the Church of England commenced | yesterday in this city. The session began | with morning prayer and celebration of Holy Communion, in ‘St. Luke’s Church. | At 2.15 p. mm. the Synod met for business | in the same church. His Lordship Bishop Binney presided.

There were 86 clerical and lay delecates | present.

His Lordship the Bishop delivered an cloquent address, explaining his reasons for summoning the Synod at the present time, so as to enable him to attend the Confer- ence to be held at Lambeth on the 2nd of July. He referred to his visit to the Mon- treal Synod last September, regretted the presence of so small a lay delegation, and suggested that in future only those who are able to attend be elected as delegates. His Lordship entered somewhat minutely into the details of the business transacted there. He also referred to the pressing need of an Academy for young ladies, controlled by Episcopalian authorities, and regretted that while the Baptists had their institution at Wolfville, and the Methodists theirs at Sackville, the Episcopalians were, as yet. only talking about one.

The following resolution previously passed, was teken up for confirmation : “That in case it shall happen that the

Bishop shall withold his assent to any act or resolution of the Synod, the same may be brought up again at the next session ; and if it shall then be passed by a majority of two- thirds of each order present and voting, and shail again be dissented from by the Bishop, such majority shall have the mght to appeal to the House of Bishops in General Assembly in Canada, whose decision shall be final.”

After being disenssed by the Revs. Dr. Hill, Dr. Nichollas, Dr. White, Messrs. Ed. J. Hodgson, P. C, Hill, J. W- K. towly, W. B. Vail. and others, it was withdrawn, and the following adopted on the motion of the Rey. Dr. Hjll:—

‘* That the House of Bishops of the Eccele- siastical Province be respecttully requested to inform the Synod of this Dhocese if, in the event of an appeal made by them on a subject dissented from by the Bishop, their Lordships would be ready to receive an appeal and give an opinion thereon.”

The following resolutions were nmously adopted :;—

‘“That each Parish represented in this Synod be assessed for the purposes of this Synod ; that the assessment be due from each Parish as soon as the amount assessed is announced to the Rector thereof, and that no representative shall be allowed to take his seat, as long as the dues of his Parish or District shall he one year or upwards in arrears.”

‘That the following regulations shall be ob- served in the election of Delegates to the Pro- vincial Synod ” :—

“If more than the required number of Dele- gates has been nominated, then the clergy shall ballot for the clerical delegates, and the laity for the lay delegates. The required num- ber of candidates having the highest number of votes shall then be put, the clerical dele- gates to the laity and vice versa; and each house must accept or reject the election of the other as a whole.” Contirmed.

“The substitutes shall be elected in the same way,after the declaration of the names of the delegates elect.”

The Synod then adjourned.

The splendid torchlight procession which, on Saturday night, welcomed Sir John Me- Donald and Dr. Tupper back to Toronto after the exacting labors of a long Parlia- mentary session, was a fitting proof of the warm place which the great leader of the Conservative Party and his able first lieu- tenant hold in the hearts of the people of Toronto, and a fitting tribute to their earnest services in the cause of the State. We have arrived at a crisis in our affairs. We find in power a Government which is running behind at the rate two millions a year, and yet goes on spending with a lavish hand—and yet hold on to a fiscal policy which even the old nations of Europe who have tried it are abandoning—and yet de- clares it to be the highest virtue to fold their arms and wait until the cloud breaks and the sun pours a ray of light through the gloom. Sir John McDonald and Dr. Tupper lead a Party which looks upon these things as alarming and tending to ultimate | ruin. They are the unyielding advocates of a National Policy of Protection. As | such, Toronto does them honor; and we | sure that the hearty, buoyant spirit which animates the citizens of capital of the West, beats responsive in the hearts of the ma- jority of the people of the Dominion. THE McCARTHY MURDER.

(From the St. John Telegraph. )

SHEDIAC, May 15,

To-days’s evidence was in the main cor- roborative of that already given at this in- quest and at the examination in Moncton, though one new witness, Milledge Lockhart, swore that Miss Osborne told him that Me- Carthy returned to their house about mid- night on the 12th. This corroborates Hay- ward's evidence at the Moncton inquiry. When the jury rose to-night, Nickerson concluded his description of the articles found on McCarthy’s body, and to-morrow the Coroner will produce the articles in Court. The Riley girls have been sent for, it isreported, and Annie Parker wil) arrive to-morrow. She will be kept in the custody ot the Deputy Sheriffat his residence. Mr. Holstead, the prisoners’ counsel, is indis- posed tonight. The attendance at Conrt was quite large this afternoon, but a big rush is expected to-morrow to hear Annie Parker.

Verbatim Report of the Evidence at the Inquest. (From the Moneton Times. )

SHepiac, Tuesday, May 15.

After routine, Mr. Tuck resumed the ex- axamination of Dr. Scott, as follows :—

The cotton of the pockets was rotten ; very little handling would cause the fibres of the pockets to separate. I formed the opinion that the death of Timothy McCarthy was not caused by drowning, because of the collapsed state of the lungs and the absence of mucus and blood in the lungs and cavi- ties of the chest. I concluded that death was not due to natural causes, because of the absence of any appearance indicating dlisease before death, either external or in- ternal, sufficient to produce death. The well-nourished appearance of the body also influenced me in coming to that conclusion. The eifused state uf the brain caused death, —the base of the brain, particularly. The suffused state of the brain and the effusion of blood in the brain would cause death. This state of brain might be produced by a blow given on the head. a consider that death was not from natural causes because of the effusion in the brain. 1 found that a large number of the smaller vessels of the brain had been ruptured at or near their capillaries. I would not expect to see such a state of brain after death from natu- ral causes, but might be seen after death from appoplexy. A blow upon any part of the head might produce this state of brain. Blows could be heavy enough to cause - death, and yet not heavy encugh to break the skin or fracture the skull. The bones of such a person as McCarthy would be less liable to fracture than those of a spare man. A mass of hair growing over the locality of the blow would lessen the liability of the skull to fracture. The brain being under the influence of alcohol or a drug, the blood vessels of the brain would be more easily broken. Alcohol or any nareotic might gorge the blood vessels of the brain, and when the vessels were thus yorged they are more easily ruptured, when the ruptured blood would follow. The snd- denness of death would depend upon the force of the blow given and the state of the brain at the time the blow was given.

J could not tell from the state of the brain how soon death followed in this case after the blow was given. It might have fol- lowed instantly. I formed no opinion as to the length of time intervening between death and being put in the water.

(Dr. Scott at this point exhibited to the Court the breast of the outside and inside shirts, explaining the positions of the stains said to be there situated. )

Dr. Scott stated that he could have no doubt but that certain portions of the stains were blood, but other portions were caused by the coloring of the facing of the waist- coat. If these are blood stains, they give evidence of a large quantity of blood hay- ing flowed from the mouth or nose. If blood flowed from the mouth or nose, it would not spurt from the mouth per saltum, but might be spurted out ef the mouth in the attempt to breathe. The nature of the wound itself would not cause the blood to spurt from the mouth.

All the clothing of McCarthy had the ap- pearance of being new at the time of death : he was remarkably well clad. I formed no definite opinion as to the length of time the body was in the water. The body had not been floating any length of time; I think the body had not risen before the day it was found. The wound over the right eye was slightly chafed. The epidermis was embedded in the wound over the eye. The wound was produced before the epidermis loosened, but [ would give no

While the examination on the charge against the Usbornes was going on at Mone- ton last January, | was ordered by the Court to make an examination of the Waverly House, and to point out to the carpenter, Who accompanied me, anything looking suspicious. While examining the har-room of the Waverly House L saw such indications as led me to have removed a portion of the floor of the bar-room and counter. They were removed, and I be lieve they are now in the Council room in Moncton. I examined these portions so taken up and found several dark stains on the floor, and the floor had some appear- ance of having been scoured and peculiar spots on the face of the counter having been indented in the counter presenting a pear shaped appearance, with the larger
