Disturbing Religious Worship.

SYNOPSIS OF THR JUDGMENT IN THE MOORE wm (ASE.

Tuts forenoon, R. R. Fitzgerald, Exq., J. P., gave a lengthy written judgment in the case of John Moore, charged with dis- turbing religious worship. In this case, said he, there are two charges sgainst the defendant : (1) that in the singing of the eanticles ‘n the morning and evening ser- vices in St. J: hn'’s Church, Crapaud, he so rend+rd thein «as to disturb the order and sol mnity of divine worship ; (2) that at the otiics of Holy Communion his conduct has been such as to prevent its due and rever- ent celebration. The Magistrate found both these eharges conclusively proven. The evidencé as tothe first charge was in effect that the defendant persisted in ainging according to the manner taught by Mr. Friese four years ago, while the rest of the choir sang in accordance with instructions more recently given by Rev. Thomas Lloyd. This caused great discord in the singing, occasionally break- ing down the choir. The defendant per- sisted in acting in this uaseemly and in- decent manner for over six months, telling the rc or, when remonstrated with, that if they did not siag the canticles his way, he (the rector) would have to read them. As

to the second charge, the evidence showed that the defendant while persisting in sO disturbing the

congregation by his singing, presented him- self for communion. This the rector re- fused him. The defendant, not satiefied with this refusal, presented himself at sev- eral subsequent celebrations and conducted himself in such # manner as to cause a mott unseemly disturbance in that service. On the last communion service of the Ist January, he behaved himself in such a manner as to prevent the rector continuing the service, and the congregation were die- missed before the service was concluded. The facts im this case were practically undis- puted by the defendant. His defence, apparently, was that as leader of the choir he had a right to sing as he did, that the rectorahad fio right to refuse him the sacrament, and he had a right to con- stantly present himself. The concluding part of the Magistrate's judgment reads as follows: I have gone over the evidence carefully. Ifind the defendant guilcy of both charges. I find that he had no excuse for his persistent, deliberate conduct. His counsel suggests that his case might be

Tue regular monthly meeting of the City Council was held yesterday afternoon at three o'clock, Mayor Haviland in the chair, Councillor MeKay was the only absentee. The returns of the recent elections for Water Commissioners were read by the clerk. Mayor Haviland explained that the commissioners elected, Messrs. Hal- loran and Laird, had each furnished the security required by law. The sureties for Mr. Halloran are Maurice Blakeand Charles Lyons, and for Mr. Laird John MePhail | and J, D. McLeod. Mayor Haviland presented the estimates | of the City School Board for 1893, which | were referred tothe Finance Committee. | The Board asks for $10,500 this year. _ A memorial fram the Ciury Clerk, asking | that his salary be increased, was referred to the Finance Committee. Councillor Crabbe moved that the ap-! pointment of all standing cotamittees cancelled. Carried. Councillor Crabbe moved the following resolution, which was seconded by Coun- cillor Hogan and carried :—
