THE FRANCHISE ACT 1898

Sections thereof which will apply to the Plebiscite vote in P. E. Island : —

5 For the purposes of any Dominion election beld withia the liuits of a pro-

| vince, except #8 hereinafter otherwise

} rovided, (a) The qualifications necessary to entitle any person to vote thereat shal] be those established by the laws of that province as necessary to entitle such person to vote in the same part of the provine> st a provincial election;

(6) Tae polling divisions shall be those established by or under the laws of that province for the purposes of provincial elections within the territory coa prised in the electoral district for which such election is held;

(f) The provisions of the law of the province as to the places where non- resident electors shal] vote shall apply mutatis mutandis to such Dominion election, and the returning officer at sucb election sball have the powers and be charged with the duties of the sheriff or returning officer under those provt- sions; but nothing herein shall enable any person to vote by schedule or other- wise than by appearing personally.

6. No person possessed of the qualiti- cations generally required by the pro- vincial law to entitle him to vote ata provincial election, shall be disqualified from voting at a Dominion election merely by reason of any provision of the provincial law disqualitying from having his name on the list or from voting,—

(a) the holder of any office, or

(5) any person employed in any capacity in the public service of Canada or ot the province, or

(c) any person belonging to or en- gaged in any profession, calling, em- ployment or occupation, or

(d.) any one belonging to avy other class of persons who, altheugh possessed of the qualifications generally required by the provincial law, are by such law declared to be disqualified by reason of toeir belonging to such class.

3. Nothing io this Act shall be deem- ed to repeal, or to aftect otherwise than is provided by section 18 of this Act, the provisions of section 42 of Zhe Dominion Elections Act, as that section has been heretofore amended. or to re- peal or affect the provisions of sections 96, 98 or 99 of the said Act, or of sections 15 of chapter 14 of the statutes of 1894. intituled Asm Act to disfranchise ceters who have taken bribes.

4. Any person who, at the time of an election, 18 @ prisoner in a jail or prison undergoing puvishment for a criminal offence, or fis a patient in a lunatic asylum, or is maintained in whole or in part as an inmate receiving charitable support or care in a municipal poor house ¢@r house of industry, or is an inmate receiving charitable support in au institution recciving aid from the govenment of the province under any statute in that behalf, shall be disquai- fied and incompetent to vote at an election.

20. It is hereby enacted that not more than one elector foreach compartment shall, at any one time, enter the room where the poll is held, and each elector upon so entering shall declare his name and addition, and in

26, Section 52 of the said Act is here- by repealed, and in lieu thereof it is hereby enacted that no voter who has refusei to take the oath or affirmation, or to answer questions or produce evi- dence as to qualifications as aforesaid, when required to do so, shall re- ceive a ba'lot paper or be admitted to vote.

27. Section 54 of the said Act shall be applicable also to electors entitled to vote otherwise than by being named on the list of voters.

29. In the province of Prince Edward Island the deputy returning officer shall alzo, in counting the ballote, place in @ separate envelope or parcel all bal- lot papers numbered and _ ivitialled under section 23 of this Act.

30. Sectioa 58 of this Act shall not apply, in the province of Prince Elwa:d Island, to the determination of the qualification or non-qualitication of any voter whose ballot paper has been nuw- bered and iritialled under section 23 of this Act.

31. Seotidn 58 of the caid Act, as en- acted by section 8 of chapter II of the statutes of I888, is herehy further amended by striking out all the words from “candidate” ia line four to “of” in line nine, and by inserting after the word “papers” in line ten the words “and of the ballot papers numbered and initialled by bim unuer section 23 of this Act.”

32. Subd-section 1 of, section 64 of “The Dominion Elections Act’ is here- by amended by striking out all the words from “or” in line fourteen to “be” in line twenty-eight, and by substitut- ing therefor: “{3) In the province of Piince Edward Island that any person not duly qualified to vote in such elec- | torial district has so voted.”
