Cable)- A rift between the British and French delegations over Connolly's pmpective participation in treaty discussions darkened tonight the future of the Four-Power Naval Conference. France has not yet replied to c. new British suggestion she agree that outside naval powers. partic- ularly Germany. be invited to send delegatio here but informed quarters felt the reply would be negative. This issue goes back to Germany's scrapping of military clauses of the Versailles Treaty last spring. France, nervous over German naval rearm- ament. contends that participation by Berlin in negotiations here would constitute open approval by the powers of Germany's violation of the treaty. . Another outstanding development today was the acceptance by a technical sub-committee of the United States oposal for the ex- tension of the illcial age of bat- tleships from 90 to 26 years. The conference must approve the com- mittee's action, but it Was believed certain the American plan will be adopted, thereby saving the tax- payers considerable money.

OTTAWA, Feb. 8—Under the far-reaching provisions of the Marketing Act, the Dominion has power to control practically every small business in the country, "pay- ing no attention to provincial boundaries or local conditions, it was submitted to ' the Supreme Court today by I. A. Humphries, deputy Attorney-General for 0n- tario.

The Ontario official joined Aime Geoffrion, representing Quebec, in a general onslaught on all import- ant clauses of the Marketing Act, claiming it was unconstitutional.

Earlier in the day, the court re- served judgment on validity of the Unemployment Insurance Act‘ and turned to the marketing legislation. It left only one of the eight laws involved in theconstitutlonal re- 19191106. the Farmers’ Creditors Ar- rangement Act. to be reviewed.

Louis Saint-Laurent attempted to justify the Marketing Act on several constitutional points. He argued Parliament had exclusive jurisdiction over trade and com- merce. He argued when Parliament passed the Act it went back on Canada's old naliolzal policy of unrestricted trade. If it could pass

The Ontario deputy Attorney General submitted Parliament's power to regulate trade and com- merce did not exfend torogulatlrlg individual industries. The power was general. not particular.

Continuing his interpretation of the Rot. Mr. Humphrles said the lumber dealer could be told when and where he could sell his pro- duct and only through an agency lie-taunted by the Marketing Board.
