Born on March 17th, 1878 at West ROY- glty, the son of Mr. and Mrs. John Bel, he was 1n the 66th year of his life. Mr Bell operated a. farm at we . In 1915 he was married to Helen Stewart of Charlottetown. who survives him. zilong with his brother 31185611 0f west Royalty, and four sisters Ger- truce, Sousan, Allie (Mrs. Gaze) 1n the West and Elizabeth (Mrs G. Johnston) in Montreal, Mr. Bell worshipped at. The Kirk of St. James. the Minister oi which the Rev '1" H. Bussellsotners conduct- ed the funeral service on April 4th. The pallbearers were: Messrs. "rho Prohibition Act was maln- tnlned in all its substantial ele- ments with the full benefit of the wave of public sentiment which accompanied the election of i027, More drastic provisions were in- troduced into the Act. More ef- fective methods of enforcement were provided. The investigation department was increased from a

force of three pectors to a force varying from fifteen to eigh- teen men.

“One oi’ the planks of the Lib- eral platform in 1927 was that after endesvorin to enforce the Act for s y would hold s

ear plebiscite. after passing these new and drastic smendmegitisd of o plebiscite in 1929, with the result

that the 1e again voted for the rctent on oi’ the Prohibition Act. A new Prohibition Commis-

sion was appointed 1n 1927 with the late w. John Agnew as its dlhlnrilm. On his death he was succeeded by Mr. George Brown, the president of the Temperance Alliance, and he continued to be chairman of the commbsion until the change of government in 193i. "Now another of these tremend- ous waves of adverse criticism rolled over the island in 1933. At that time Premier Saunders gave a very exhaustive and elaborate review of the administration of ihl Act under his government.

Drastic Amendment

"There was one other respect 1n which the Saunders Government injected a new and drastic method of enforcement. There has ways been since the Act of 1918 at least, s. certain amount cf dis- trust of the courts in connection with the enforcement of the Pro- hibition Act. The law provided that although the Crown or pro- secution could appeal against a dismissal of the case, the accused Person who was convicted of a

charge-it did not matter how high the penalty might be - had no right of appeal. Even with

that drastic provision, and even with the drastic penalties and the taking away of the right of appeal of accused persons rom a seu. tenocd imposed by a magistrate, the advocates of drastic enforce- ment still did not feel that the cards were stacked severely enough against the accused. And so the incoming government of 1927 posed a provision that Prohibi- tion cases should be heard by a special magistrate or magistrates appointed for that special pur- pose, appointed by the government on the recommendation oi the Prohibition Commission oi ulioiu the president of the Tlempcraiico Alliance was chairman, and the principle was continued that no appeal should lie from a convic- on.

“One would have expected that conditions under those circum- stances would be well-nigh ideal. At time another detective was brought down from another reputable Montreal firm, and he made an investigation, this time particularly in Silmmersldc, and n. very heated discussion arose in the House and elsewhere over the action of that particular detec- tive. we have the historic utter- ance of Premier Saunders him- self on that occasion that condi- tions ‘have been intensified a hundred-fold, yes, a thousand- to what we had two years ago...It is only a few vcars ago that we read there were stills in the Province, but they have in- creased and the methods cf the bootleggers resort to are almost beyond the comprehension of men, and as a result it is difficult to cope with conditions.‘

law were one move behind. Pre- mier Saunders described very vividly the methods which were used by bootleggers of “Win. days to bide their operations from the minions of the law. He described the system known as peep-holes, the concealing of liquor in hot wat- er bottles behind the baseboard of looms in houses, etc. In many cases it was concealed under the sidewalks and sometimes on the rafter of horse stables.

“And so for the second time in four years the leader of the gov- ernment had ve emphatically pointed out the dif iculties of en- forcement of the Prohibition law even under his own government,

and with conditions as ideal as thattegovernment could possibly crea .

Prohibition Commission

"In 1940 l’. had the honor to be come Attorney General of the Province, and the Prohibition Act at that e was enforced by a Prohibition Commission. I found in Mr. Brown and his colleagues of the commisicn a very ener- getic body, conscientiously devoted to obtaining the very best enforce- ment of the Act. But. in this sys- tem of enforcement by a commis- sl0ll I found a great man, anom alies which in later yrears ied me. with the cordial co-operation cf the late Premier Lea, to advocate its discontinuance. In the first place, on the face of it, the hand- ing over of the administration of an important detgartment like that to an irrespons le commission is s negation of the princi ies of re- sponsible government. here was no such thing in those days as the blldrletlllg fOr expenses and re- CBllllS of the prohibition enforce- ment. The appointments were made 0n the recommendation of this commission. Sometimes they were wise. sometimes they were unwise, but there was not in the system that degree of respon- sibiity which 1S the basis of our democratic system.

"There was a. further anomaly of the Attorney General of the Province being entirely excluded from any part in that administra- tion. nnd yet being held respon- sible to the electors for all the cle- fects in the administration, real and imaginary.

“Within a car I had the pleas- ure, or “Der ence at least, of con- testing two elections, one in 1930 and the other in 1931. And one of the most difficult prolilcms which I hati to face in conducting

those campaigns was the charge that ihc Saunders Government and the Lea Government and my- self as Attorney General of the Lea Government, had failed and neglected to enforce the Prohibi- tion Act.
