Thomas Fiynn, (sworn)—I am the City Marshal. The case was given to me to work up the morning after the robbery. I examined the premises in the presence of Mr. Aitken, Mr. Albert Carvell, and Mr Rattenbury. I told Messervey to go to Dawson’s on the morning of the Wednes- day fi llowing. I made enquiries on the Saturday feilowing, and found that some business had been transacted by Bla‘ch and E. W. Dawsen. J reported this the same evening to Mr, Aitken and Mr A)bbert Carvell. .On. Friday, afternoon, the day after the robbery, i was told by Mr. Aitken that suspi¢ion rested upen the prisoner. 1 had the first conversation with Messervey in reference to this money on the Friday following the robbery. Up to that time T had dealt only with the principals of the ‘firm. Messervey told me what the note consisted of. At this time, I spoke. of , Sending some one to Dawson's to see if any | preenbacks had been paid to him by Blatch. ‘I said that It should I]ke to get somebody to go. At that time I did not care to send |him, nor did Toask him togo. J did not | know that he could identify the money at ithe time, On Wednesday I saw Messervey

Note, but was not sure that he could iden- tify this. He also said that there was a £20 Greenback which he knew. He told me the note was pale on the face of it, and delibie penci’. That was the only descrip- identify the note. This was the first time I pointedly asked him if he could identify the money. I told him that he had better go himself to Dawson’s to see if he could get some Greenbacks from him. I never saw the note until I saw it in Court. 1 got a warrant and asearch-warrant, aud served them on Saturday last. 1 saw Blaich m his office, and there arrested him. I] searched him, and found nothing.

(Cross examined by Mr. Davies.) The pews of his arrest, and his arrest were simultaneous. He had no time to make away with anything from his person, to re- move anything from the offive, or to com- municate with home. He was searched by officer Cameron, in my. presence. I made a. thorough examination of the County Court office. I searched every place where i} thought anything might be concealedi Officer Cameron and myself searched: his house, and every part of his tremises. We found nothing. His wife was sick and weak; there was a baby there and a nurse Mrs. Stewart. I made an examination of Carveil's premises the morning after the robbery. I saw the box of pipes referred to with footmarks on it. These pails, now produced by me, are cxactly as I received them. I got them from Jed Carvell. ’ He: vave me these two naits and apiece of a! shingle nail which I threw away. There is vo marks upon them except the private marks I put upon then” On Friday when I went down to Carvell’s office [ believe all the employes were there, in- eluding Messervey. Ritchie was not there that lL remember. I was there two or three times that day. I was not down the evllar that day that I remember, though I might have been. I got to the office the morning after the robbery not later. than ten minutes after 8 o'clock. Mr. Aitken went in a ahead of me and went nght up stairs. The first I heard of the ro>bery was that the safe had been vcobbed. The first thing “Jed” asked me was if I had been down ear!y in the morning. Occasionally I do go early, I said “‘no,” He said somebody has heen here. JI asked why, and he said. that when he came down he found the window back of Messervey’s office open. I was the first to go into the cellar, not more. than 15 or 20 minutes after. [saw the box of pipes under the outside hatch standing on end with tootmarks on it. On Friday morning Blatch’s name was connected with the robbery. I thought it strange when Blatch passed me looking for his can, that he did answer me. I donot kiiow how this can got down into the cellar.

Cross-examined by Mr. Davies— If I was sifting down at Measservey’s desk, a person could not see me until he came within two or three paces. Blatch passed me over six feet from it. I was. sitting down, and the counter was about on a level with my head. When I| used the word ‘*minute” in my answer [ meant a short space of time, 1 cannot say exactly how long. Blatch dia not say to me that he saw his can in the cellar. You can seé the cellar floor from the top of the hetch. I have several times put the stick in the staple of the outside hatch. I remember one occasion last fall, but I cannot say whether it went in easily or nob, The stick is loose and can easily be taken out. I have taken it out since the robbery. 1 am not sure that this is the same plug that was in the hatch at the time of the robbery. When I stood over the hatch I was looking down, but did not think of keeping Blatch in sight. I ~ill not swear be was down in the cellar a minute; the time was very short. (Witness was timed from which it appeared that Blatch was down in the cellar about lo seconds.) I think I told Mr. Aitken the direction I saw Blatch coming from down there. 1 I might have told the Marshal but cannot remember. I did not take the money. I was home that night. From the way these nails were put in, I think the doors could . be burst wpen without injuring them p+ remember hearing afterwards that one of the nails was bent. They do not appear to” be ‘so now, bat there was another nail I got no Wages ag yet.

On Friday morning, at the opening of , the Court, Mr. Davies argued for the nght of witnesses tobe examined in the defence of the prisoner. Counsel quoted) many anthorities t» sustain his argument.

Mr. McLeod followed, quoting authori- ties to shew that such a right was to be exercised only in certain caves, which cases were uot analagous to the one now proceeding. If the Magistrate thought that he could exercise a discret-on in the mat- ter, Mr. McLeod contended that it could oniy be so aiter Blatch had been asked for a siatemeut, and after that statement had been made.

His Honor the Stipendiary Magistrate said that he wished not to give a decision at once on the matter, avd adjourned the case until Monday. In case His Honor decided in favor of Blatch’s counsel, Mr. Davies proposed to call the following wit- ~
