U.S. Courf Decision May Affect Canada’s Treaty .

CINCINNATI (AP) _The U.S.

government Friday asked the Court of Appeals. sixth circuit. to reverse a lower court in a tax case that might affect treaties with Canada and 19 foreign coun- tries. ' The case before the three-judge tribunal was an appeal by the U.S. treasury department against Consolidated Premium Iran Ores Limited; Cyrus 6. Eaton, Cleve- land, Ohio, financier. and William R. Daley, co-owner with Eaton in the firm.

After hearing arguments. the appellate court took the case un- der advisement.

_The appeal was taken. by the

government after 'a fax court in Cleveland held that the corpora- tion. Eaton and Daley cannot be held liable for $4,559,418 in in- come and excess profit taxes for the years 1943 through 1949.

The tax court held that collec- tion of such taxes would be in violation of the tax treaty be- tween the United States and Can- ada.

It held that the corporation con- ducted all its business in Canada, and therefore was tax free inso- far as the U.S. was concerned.

One of the most enthusiastic of the hundreds of spectators was VonClure Gay. 101 years old and still active and alert.

Ores could be made. to pay taxes tested not only the treaty between the U.S. and Canada. but similar treaties between the U.S. and 19 foreign nations.

“If this is treated as a legal question. it will be of tremen- dous international importance.“ he said.

Fortas said the chief issue was whether Premium Iron Ores had a “permanent establishment" in

the U.S. The tax court had held

that the organization was strictly a Canadian firm and maintained no offices or agencies in the U.S.

TO PROMOTE TRADE

The lawyer declared the clause in tax treaties regardingperma- nent establishmean in the U.S. was “administered to promote trade and to prevent Canadian businessmen from double taxa- tion. and from being harassed if they come here by imposition of local taxes."

He also contended the treaties protect U.S. businessmen from the same situation in Canada and other countries.

Specifically, the government charged that Eaton and Daley represented Premium Iron Ores in certain business undertakings from their office in Cleveland.

Answering that. Forlas said the Cleveland offices are those of Otis and Company Incorporated, an investment arid securities firm operated by Eaton and Daley. Neither man was authorized to conduct business for Premium Iron Ores because neither was an officer or employee of the com- pany, he argued.

He contended they merely were stockholders.

Springhill’s Courage Amazes

Mr. and Mrs. Edwin MacRae of Charlottetown travelled Sunday to Springhill for a first hand glimpse of conditions in that disaster torn: town.

On her return .Vlrs. Sonia Mac-i Rac gave the following account of what she and her husband had seen and her impression of the people and how they are stand-L ing up to the worst of the three calamitous occurrences of the past two years:

“As we drove through Spring; hill this Sunday Oct. 26 less than three days after the dis- aster that shook the entire na- tion. one thing seemed to dom- inate Main St. that was the Miners Memorial. a silent re- minder thai this little town had already given 164 men to the deeps.

“Soon after we arrived at the No. 2 colliery of Cumberland Railway and Coal Co. I ascd myself how this staunch little town could stand the third dis- aster in less than two years and I must confess that I honestly felt that Springhill. would fold up and become a ghost town. and who could blame them? But as the day wore on and I questioned more and more peo- ple involved in the tragedy. there unfolded before me a story of such tremendous cour- age and determination that I somehow knew that Springhili would pick herself up and go on.

"The first person I talked to was a young lad in his early teens who had a father. brother and brother-in-law still down in No. 2 mine. when I asked him if he had any hope for their rescue. his eyes filled with tears. and he answered ‘lt's out of our hands now'.

TWO DISASTERS

“i talked brieﬂy with anoth- er man who had survived bOLII disasters and when I questioned him as to whether he would re- turn to the pits, his answer was an emphatic ‘yes’.

“Another miner with 35 years experience was Chas Savaney who survived the 1956 explo- sion. in fact he was the second last man out at that time and went for five days without food. He told me that he had no hope whatsoever for the trapped men. I pressed him further as to whether he thought the mine would reopen and he stated that he felt No. 2 mine would be closed. however it was his opinion that No. 4 mine was in fairly good shape and would again be put into operation. I queried him as to whether he himself would go down again. and he answered simply, ‘I don't know anything else’.

“Quite frankly I was at a loss to explain such stoicism. but I encountered it at every turn; no. tears. no hysteria just a quiet acceptance and so often

"My next stop was at the mine rescue station where I had hoped to talk to some dracgermcn. the specialists of mine disasters fam- ed for their courage and endur- ance. However. I didn't have the heart to question them because they looked so completely weary and haggard but I did find out that in the past two days they have gone only 20 feet down in No 2 mine. That means they still have 80 feet in order to reach the 13000 ft. “all and the tempera- ture in that pit is 90 degrees.

“At this same rescue station I talked to young Jerry Boss (well known in hockey oirclesl who told me that he had turned down a job in Amherst because he liked be- ing a miner. however. he intend- ed to try the mines in Cape Bre- ton. lncidentally. this young fel- low is a draegerman in-train-ing, apparently it takes two years of training before they can be used

open up either N0. 2 or No. 4 ‘Do you know.‘ he said. ‘in an average day we get about five or six small bumps. this big one was bound to come."

“My next stop was at the arm- ouries where l chatted with the chief of St. John Ambulence. He explained that the survivors had all been moved to the hospital, this was now set up as a tem- porary psychiatric centre to help those who just could not take any more mental abuse. The volun- tary work being carried out by these people as well as the al- ways efficient Red Cross and the Salvation Army is really beyond estimation.

INTERVIEWS MAYOR

“Finally. just before we left Springhill I was fortunate enough to have a short interview with Mayor Ralph Gilroy at his office in Town Hall. where he was pre- paring for a television program. His Worship told me that on one street alone 26 men were among the victims of this terrible disas- ter, and that one man. another victim. left behind him 13 child- ren. His wife gave birth to their 13th child on the same day he be- came trapped in the mine. But in spite of all these little tragedies woven into one big tragedy the spirit of the people of Springhill was very much alive.

“I asked the mayor what he thought the future held for Spring- hill and whether he thought the mine would reopen. He answered that he had changed his thinking in this respect. He felt that since both mine; were so hazardous. and the past two years have prov- ed this. that pressure and influ ence from all levels should be brought to bear on A.V. Roe Ltd to give up the mines and estab- lish one of their many other in- dustries in Springhill. “we‘ll just have to make them see it," be de- clvared.

“The next question I posed was the extent of federal aid after the 1956 disaster. and I was told by the Mayor that Ottawa had con- tributed 25.000. but. he said ‘we honestly feel we will receive a great deal more this time.‘ Fin- al I inquired abou the disaster re 'ef fund was told that one mil- lion dollars would have to be rais- ed this time. ‘otherwise. we'll nev- er get through the winter.’ the Mayor added uietly.

“As I sat on the ferry on my way to the little Island I am for- tunate enough to call home, I wondered helplessly how I cOuld express all the things I had seen and heard. never in my life before have I witnessed. such determina- tion and sheer couragecounage born of an inner strength. the same kind of inner strength that almost personifies a Maritimer."

Mr. Tanner's knuckles were rapped particularly for having ac- cepted. in addition to some 55.000 shares at $8 each. 10.000 shares at $1 each. The current price is about $36.50.

BEYOND REASON

Turning to Westcoast Transmis sion. which ships gas to the Cana- dian west coast and to the north- western U.S.. the commissioners said company backers received “potential capital profits beyond any amount which . . . could be considered as reasonable or ade- quate compensation for the risks involved."

Before shares were offered to the public. 624.950 were issued to the backers at 4.9 cents and five cents each.

Among those who got big chunks at this nominal price

were: Westcoast president Frank McMahon of Calgary; E. A. Parlnford; P a c if i c Petroleums Limited, a company headed by Mr. McMahon; Sunray Mid-Con- tinent Oil. Company Limited: and Eastman Dillon and Company. a New York financial firm. Nearly all of the shares offered to the public at Sir-just a frac- tion of the current price—were sold in the U.S.

CONCERN OVER PRICES

Touching on the pipeline situa- tion. the commission expressed concern over the possibility of ris- ing gas prices to Canadians. For example. in British Columbia dis- tributing companies pay almost 50 per cent more for Westcoast gas than does an American com- pany taking Westcoast exports.

Prices had to be “fair and reasonable.” Pipelines shouldn't look to Canadians to bear too large a burden of the costs.

Yet on the whole. the commis- sion agreed that the big market for surplus Canadian gas is the U.S. Over the years there would be rising sunpluses in Canada available for export.

The commission expressed con- cern over the possibility of rising sunpluses in Canada of gas by— products. such as sulphur, liqui- fied petroleum gases and natural gasoline. Granting of a gas ex-

TIGHTEN CONTROL

The major recommendatiom dealt with strengthening central control over the industry. Without such control. the commission sug- gested. the pipeline profits of Trans-Canada could become ex- cessive.

The proposed national energy board would have three to five members.

It would study the entire industry. recommend policy changes to the government. do- cide on applications for exports and imports. the development of new exploration companies and pipelines. Decisions would be based on what was in Canada's best “national interests."

While the board would have policy-making and licensing pow- ers. the board of transport com- missioners. which currently deals mainly with r a i l w a y freight cases. would have increased pow- ers to deal with pipeline regula- tion.

The commission said the board should be forced to regulate prices. tariffs and tolls of pipe- lines which come under federal jurisdiction. Tolls set should be reviewed at least every two years.
