SUSPENDED ROADWAY.

Sia, —Aa« the Land Surveyor respons- ible for placing the site of the proposed roadway on the upland, and not on the shore, in front of Government farm, will yeu permit me to make, through your columns, a few brief comments on the re cent decision of their Honors the Judges of the Supreme Court in relation thereto. Their decision, in substance, is, that the act of 1876 is in force, that the land pro- posed to be opened as a roadway by the city is not comprised in the premises vest ed in the city by eaid act, and that the city bas shown no right to it, that an ipjunc- tion must be granted, and that the city is entitled to “a strip of shore front of @ width not exceeding one hundred feet run- ning from Kent Street along the outside of the existing bank of Government farm till it strikes the said jine from Brighton Road to the shore, for the purpose of a carriage or roadway to and from the said Park. The term ‘existing bank’ means the bank as it existed in 1876, when the act was passed.” Here let me remark, that as the judges came to the conclusion that the pisn differed from the act, the cen

cluding words of the description in the act “as the said carriage or roadway is de in

eated upon the said plan” were left out,the plan was set aside, and in consequence of this the date of the “existing bank” was changed from 1873, the date of the plan,

to 1876, the date of the passing of the Act. The court, though declaring that the

proposed site fora roadway is not vested in the city, have given uv intimation in their decision (as published) as to its pro- per location, beyond quoting the descrip tion is the statute, curtailed as above men- tioned. Now the land surveyed by me for the site of the roadway agrees ‘in every particular with this curtailed description , as well as with the full description in the Act and the plan referred to therein. It is a shore‘front, it does rot exceed 100 feet in width (measured from the outside of the existing bank of 18753) and it from Kent street along fhe outside (not outside) of the existing bank of Govern ment Farm till it strikes the line from Brighton Road to the shore (thus far the curtailed description) and it is situate on the upland as delineated on the plan. Let anyone who denies this fact give me his reasons for so doing.

l regret very much, that contrary to the ueual custom in. such cases, no reasons have been given by the Judges for their decision, unless the allegation “that in so far as the plan referred to ia the Act of 1876 differs from the Act itselt, the words of the Act supersede the plan” be one. The Attorney General’s claim on behalf of ,tne Lieut-Governor, as stated in the special caee submitted to the Supreme Court, perhaps gives some idea of their vature. The claim is that the Act of 1876 “gave the city a strip of land entirely out- side of the edge of the then bank, in fact that the land given to them was a piece of foreshore and not land above the bank at all.” What the Act really did give, was “a strip of shore-front running along the outside of the existiag bank.” qThe difference between the Lieut.-Governor’s

claim and the grantin the Act is this, viz, that by the former, the land must necessarily lie outside or on the shore

side of the edge of the bank, while accord- ing to the latter, the strip of land—were its position not fixed by the worda “ghore front” in the description and by the plan—might lie on either eide of the outside of the bank, the term “tae outside of the bank” beinz nei- ther more nor less than the aatural bound- ary line separating the upland on one side from the shore on the other. It might be termed the foot of the bank or any other equivalent, without affecting the sense or force of the description. It is from thie natural boundary line that the width of the roadway must be measured; there is no other. Upon which side of this natural boundary line the strip forthe roadway lies is settled by the words “shore front” and by reference io the plan, both of which point outthat it lies upon the upland. Again, the words “shore-front” and “foreshore” are not synonymous. Street-front, river-front, lake-front and shore-fromt are definite and well under- stood terms, and “shore-front” can no more be taken to mean front—shore, fore-shore, or any oth r shore, than street- front can be made to mean front-street or a horse-chestnut a chestout horse. Mr. L. H. Davies, Q. C., M. P., in the fore - front at the bar and as a legislator, in his place in the house of Assembly in 1876, when speaking of the Roadway, used the words * shore front” in the sense claimed by me, viz, ; that it is not part of the shore, but a piece of land overlooking

Having fully considered this matter, both before making the survey and since, I have come to the follewiug conclusions, viz.: That the strip of land surveyed by me for the roadway is the land granted to the city for that purpose by the act of 1876; that the Act and the plan referred to therein are in harmony with cach other, and sbould be read as one document, and ought not to be separated; that notwith- standing the plax has been iguored by the Judges, the etrip of land +o surveyed, is in full accordance with the description in the Act; that the Lieutenant-Governor’s claim as set out inthe special case above referred to, hasn’t a leg to stand upon, ex- cept the Judges’ decision; that the Judges’ decision is not in accordance with the words of the statute, or with the plan re- terred to therein; and las‘ly, that an appeal to the Supreme Court of Canada would be sustained.

As this is a public matter, I have thought it to be aduty, both to the citi- zens of Charlottetown and to myeelf, to vive wy views on the subjec’.
