On the payment of the amount of the Fishery Award to Canada, our merchants who had suffered from the refusal of the United States to refund duties accordisg to the Fish-Thornton arrangement of the eighth of May, 1871, petitioned the Govervor-Genera! that they might be indemnified out of the money paid by the United States for the use of our fisheries. The Dominion Government considered the case, aud came to the conclusion that as no further claim could arise against the United States under the Treaty of Washington, it was their duty to indemnify these merchants out

To make good to those merchants of Prince Edward Island, who were British subjects, the amount of duties paid by them to the United States Customs on fish and fish oil in the year 1871, under the arrangements entered into in advance of the legislation neces- sary to bring the Treaty of Washington into force, by which arrangement United States fishermen were granted liberty to fish in the territorial waters of Prince Edward Island, on the under- standing that the President of the United States would ask Congress to refund those dutics, which arrange- ment the President subsequently de- clined to carry out on the ground that the proposal contemplated the united action of all the British North Ameri- can Colonies, which was not had, and that it would not be practicable to separate the colonies or carry into effect for one what the President was willing to effect for all, it not having been deemed advisable in the general interest of the British case to put for- ward and press the claim of these merchants before the Halifax Com- WRMNRET, woccdisicsectces teeeteeeeeees SOU,086 18 Ifthis vote had carried every person
who was a British subject and had ship- ped fish or fish oil to the United States in 1871, would have had the amount of the duty refunded cn his proving to the satisfaction of the Auditor-General, that his claim was genuine and that it came within the terms of the Parliamentary vote. No British subject having an honest claim could fail of recovering his refund, unless the sum voted should prove insuflicient to cover all the claims, in which case parliament would next | year be required to vote a further sum. In case the bona fide claim of British subjects would not absorb the whole amount voted, then, the balance would remain in the Federal Exchequer. The Patriot says that it would not be the business of the Auditor-Geueral to ex- amine these claims. Such a declaration is remarkable coming from one who has been a Cabinet Minister. If the vote had passed, the memorandum above quoted, would form part of the Domin- ion Statates, and it would be the duty of the Auditor-General to authorize no payment except il was strictly in accord- auce with the law.

WE regret to learn that P. A. Larkin, Esg., Town Councillor of Summerside, met with an accident on Friday evening, which terminated fatally this»morning. Mr. Larkin was examining a vicious mare be- longing to Mr. Heckman, and received a kick in the abdomen from the beast. At the time, it was not thought serious, but on examination it was found that he was very badly injured, internally. Medical aid was called, but the doctors found that it was impossible to avert fatal consequencess The unfortunate man lingered until this morning, when he died in agony. He was a man about forty years of age, who re- ceived the respect of all who knew him. To his bereaved widow and children, we tender our sympathy. >

The last mile was pulled in the hardest kind of style, Hosmer gradually increasing his lead to fully forty lengths over Teemer, who was three lengths ahead of Riley and Plaisted, and they closed in that order, Hosmer finishing in 23 minutes and 16 seconds, Teemer 2nd, Riley 3rd, Plaisted 4th, Kennedy distanced: THE THIRD MEAT WON BY HAMM.
Word was given for the third heat at 11 40 o'clock in the following order: Hamm, Ist; Weisgerber, 2nd; Gaudaur, 3rd; Elliott, 4th, and Clayton, 5th. Gaudaur sprung well to the front and passed the mile at a 30 stroke and full two lengths ahead of Hamm. Clayton steered badly and after taking Elliott’s water crowded into Weis- gerber and Hamms. At the three quarter buey the three men were so close together that Hamm was compelled to cease rowing. Weisgerber’s shell was probably filled with water, while the three shells were locked together. Weisgerber stopped rowing and was delayed for fully one minute bailing out and after proceeding a short distance further Elliott also ceased rowing and the two men abandoned the race. The struggle between the remain:ng three oarsmen was continued sharply, Hamm _ turning the mile-and-a-half buov first in 10 mins, 40 secs., Gaudaur second and Clayton third.
Kennedy’s failure to make good time in the second heat was explained. Toward finishing, his shell, which had been injured the day prévious, parted completely in two and he was compelled to make his way to the shore clinging to the fragments. The result of the three heats make the starters for the decisive race, this afternoon ; Han- lan, Lee, Hosmer, Teemer, Gaudaur and Hamm.

Putiman, June 22.—Hanlan won the de- ciding heat in 22 mins. 30 secs. Hosmer second, Hamm third.
Hanlan passed the line in 22 min. 30gee., Hosmer in 22 min. 25 sec., and Hamm about 10 seconds after him ; Lee 4th and Teemer 5th.
Hosmer proved to be the only man who could crewd Hanlan. In the tinal race of the day, after heading Lee he sprang alongside his great antagonist and raced him nearly to the turning or mile and a half buoy. Hanlan had to display his marvellous speed for fully that distance be- fore he could shake him off. After that, Hanlan appeared to have it all his own way, and with a comfortable interlude between himself and Hosmer, he ventured to doff his red cap to those on the press boat, but he had no time to spare for any more such pleasantries. He finished at a 32 stroke.
Tur Supreme Court closed at Summer- side on Saturday. All the jury trials were closcd on Friday, and Saturday was de- voted to hearing appeals. Six Scott Act appeals were heard, and three of them allowed without costs, on the ground that the fine being for a second offence, the con- viction should show on its face a conviction for a first offence, and as they stood, they only showed a first offence, while the fine was for a second offence. In the other three appeals, judgment is reserved.
