Millman got the Pioneers first run in the last of the first when he walked, stole second and reached third on a wild pitch and scored on Larkins’ sacrifice. Jim Millman and H. Found Guilty Of Criminal Negligence. Jury Strongly Recommended Court's Clemency.

Two years’ suspended ‘ with recommendation for cancella- tion of his automobile driver's ll- censc was given Ralph Muttart of Summerslde yesterday by Justice A. E. Arsenault when a Supreme Court Jury found the driver of the auto- mobile which killed Walter Clark of Kenslngton last November guilty of criminal negligence. The jury strongly recommended the court's clemency.

Mutt-art was tried on a charge of manslaughter laid against him in connection with Clark's instant death when a horse and wagon he was driving were struck by the ac- cused's car.

The verdict was returned under section 284 of the Criminal Code of Canada, which provides im-. prisonment for two years to any- one found guilty by negligently causing bodily injury to any per- son.

Mr. K. M. Martin, K. C., made a. plea on the prisoner's behalf when called for sentence. He asked the court to take into consideration his comparative youth, his hitherto blamebcss character, after fifteen years of blameless car driving. and that the civil cialm for damages had been settled, and lastly the very strong recommendations for mercy contained in the verdict of the jury.

His Lordship in passing sentence, stated that he would take into con- sideration the repre entai/ons made by counsel. He would also consider the fact there was no criminal in- tcntlon on the part (I the accused and that alter the accident he did not run away but rendered all the assistance he could. Also that his previous record was good and that this was the first time in this pro- vince there had been a conviction under section 284 in a matter of this kind. In view of all this and the fact that the jury had strong- ly recommended mercy, he would suspend sentence and the prisoner be released on his own recognizance to be of good conduct. during a period of two years and a. recom- mendation to the governor in coun- cil that the prisoner's Iicense would be cancelled, if one has been issued and none be is.ued for a period of one year from this date.

This case had to deal with those who do not intentionally commit a. crime, but through not using reasonable care to safezlllfd the public, transgmss against that part of the Criminal Code, which says, that anyone having in their possession a thing, lnaminate or animate, which is dangerous to the public. and through neglect OF carelessness in its use endangers publfc life is guilty of criminal negligence. This His Lordship point- ed out is the means the law uses to safeguard the public.

Li a driver speeds up an a long stretch of road, that is more or less his own concern; but if he has not a. full view, if he speeds, then he does so at his own risk. Under the Criminal Code, drivers are under an obligation to use rea- sonable care. This applies to any- thing that is dangerous and every one must take precaution not to injure the public in the use of such things. Eds Lordship pointed out that it was for the jury to weigh the evidence and to decide whether the prisoner was us‘n3 reasonable care. one driver saw the horse and wagon and the other did not. Twi- light is admitted to be a. danger- ous time to drive. but that is more reason one should drive more care- fully.

The Drisoner said. he had his car under control. it was quite evident that he had not. Prisoner may have been looking at the approaching car and that is why he did not see the wagon. His Iflrdshlp went on to say that no er.» wants to convict a young man for an accident. Punishment for C.'imJ is glven as a deterrent for others. If crime is left unpunishcd others are encour- aged. The law must protect life and property. If the prisoner was gull- ty of criminal negligence he should not go unpunlshed, as it would cause others to take chances. It has always been the law that anyone must not endanger life and prop- erty. i‘ you do so you come within the law.

Fatal accidents sometimes happen through the victims own fault, and not the fault of the person hand- ling the instrument. This is called misadventure. The question here is,
